Terms of Service

1. Scope

1. These Terms govern your use of the BuruVibe iOS app (the “App”), provided by kohagura maimu (“we”, “us”, or “our”).
2. The App is licensed under the Apple Standard EULA, included in the Apple Media Services Terms and Conditions.
3. These Terms supplement the Apple Standard EULA for matters specific to BuruVibe, including its features, Premium features, advertising, and safe use.

2. Age and safe use

1. The App is intended for people aged 9 and older.
2. If you are under 18, obtain consent from your parent or legal guardian before using the App or purchasing paid features.
3. The App provides haptic feedback and background sounds for entertainment, relaxation, and help with focus. It is not a medical device and is not intended to diagnose, treat, or prevent disease or provide other medical benefits.
4. Stop using the App immediately if vibration or sound causes discomfort, pain, numbness, nausea, or any other unusual symptoms.
5. Do not use the App while driving, performing hazardous work, when your device is overheating or charging, or in any other situation where it cannot be used safely.
6. If you use a medical device or vibration or sound could affect your health, consult a doctor or other qualified professional as needed.
7. Hold game controllers in a safe place where they will not fall or collide with anything. Follow the manufacturer’s instructions for straps or other safety accessories.

3. Features and device compatibility

1. The App includes features such as preset vibrations, custom vibrations, background sounds, and vibration output through compatible game controllers.
2. Controller vibration is available when iOS exposes the controller’s haptic capabilities to the App through Apple’s Game Controller framework. A controller’s ability to connect to an iPhone over Bluetooth or another connection does not necessarily mean that the App can make it vibrate.
3. We have tested an Xbox Wireless Controller on a physical device. Other controllers will generally work if the App recognizes them as supporting vibration, but we do not test or guarantee every combination of manufacturer, model, connection, operating system, or firmware. See Game Controller Support for the latest information.
4. Vibration strength, playback availability, perceived vibration, and background sound playback depend on your iPhone or controller model, operating system, settings, firmware, hardware condition, and other aspects of your setup.
5. Controller vibration is intended for use while the App is on screen. Continued vibration while the screen is locked or the App is in the background is not guaranteed. Vibration stops if the controller disconnects.
6. We do not guarantee identical vibration, volume, effects, or behavior across all devices or controllers.

4. Remote vibration

1. Remote vibration sends and receives vibration control commands between devices only after the invited user requests to join and the inviting user explicitly approves the request.
2. Use this feature only with the consent of the person receiving vibration. Stop immediately if they ask you to stop or end the session. The receiving user can pause or leave at any time.
3. Share invitation links and join codes only with the intended person. Do not post them publicly, forward them to others, or handle them in ways that could allow unintended participants to join.
4. Do not control vibration without the other person’s consent or use this feature to harass, threaten, force dangerous actions, or cause discomfort or danger.
5. Network conditions, device usage, operating system restrictions, and other factors may cause delays, interruptions, disconnections, or simplified vibration output. Continuous or immediate operation is especially not guaranteed when the App is not on screen.
6. The receiving user chooses whether vibration is played on their iPhone or a compatible game controller. The sending user cannot select the other person’s output device. The controller requirements and limitations in Section 3 also apply to remote vibration.
7. This feature transmits vibration control commands only. It does not transmit calls, audio, video, or messages. Use your own safe means of communicating with the other person.
8. We may restrict, suspend, or change all or part of this feature without notice when needed for safety, quality, or operational reasons.

5. Data stored on your device

1. Custom vibration patterns and their names, background sound and volume settings, vibration output devices, strength settings for each output device, and some other data are generally stored locally on your device.
2. We do not guarantee that this data can be backed up or restored.
3. Data may be lost when you uninstall the App, your device fails, the operating system changes, or you reset your device.

6. Free and Premium features

1. The App can be used free of charge. Some vibration patterns, background sounds, custom pattern limits, background playback, vibration lock, app icons, remote vibration invitations, ad removal, and other features may be offered as Premium features.
2. The available Premium features, prices, durations, and other conditions are as shown on the in-app purchase screen or in the App Store.
3. We may change free or Premium features to improve the App, meet operational needs, or comply with laws or platform rules.

7. App Store payments, renewal, cancellation, and refunds

1. BuruVibe Premium purchases, billing, renewals, cancellations, and refunds are handled through App Store in-app purchases.
2. Auto-renewable subscriptions renew at the end of each period unless you cancel through the App Store or the subscription settings in your Apple Account.
3. Manage cancellations, refunds, payment methods, and other billing matters through the App Store or your Apple Account, following Apple’s procedures.
4. Refund eligibility and procedures are governed by Apple’s rules and applicable law.
5. Restoring purchases requires an Apple ID and an internet connection.

8. Ads and rewarded ads

1. Free users may see advertisements.
2. Ad formats, frequency, and content may vary based on usage, advertising providers, network conditions, and other factors.
3. Watching a rewarded ad may unlock a feature for a limited time. This is temporary access, not a BuruVibe Premium purchase or a permanent entitlement.
4. Rewarded ads and their benefits are not guaranteed to be available at all times. Availability depends on ad inventory, network conditions, advertising providers, and other factors.

9. Prohibited activities

You must not:

1. Access the App without authorization, reverse engineer, decompile, modify, analyze, or engage in similar activities.
2. Bypass payment, advertising, usage limits, or other mechanisms in the App.
3. Use the App in violation of laws or public order and morals.
4. Infringe the rights of others.
5. Use the App in unsafe situations.
6. Interfere with the operation of the App.
7. Engage in activities similar to those listed above.

10. Intellectual property

1. Rights to the App’s software, interface, images, audio, vibration patterns, and other content belong to us or their respective rights holders.
2. You may use the App personally under these Terms and the Apple Standard EULA. Without our permission, you may not copy, republish, sell, redistribute, modify, extract, or otherwise reuse its content.
3. You are responsible for managing the names and contents of the custom vibration patterns you create.
4. Third-party company, product, and service names in the App or support materials are trademarks or registered trademarks of their respective owners. Their inclusion does not imply endorsement, sponsorship, or affiliation.

11. External services and privacy

1. The App may use Apple, RevenueCat, Google, Amplitude, Supabase, and other third-party services for purchase management, advertising, usage analytics, remote vibration, inquiries, review prompts, and other purposes.
2. These services are subject to their providers’ terms and policies.
3. See our Privacy Policy for information about how personal information and other data are handled.

12. Changes, interruptions, and discontinuation

1. We may change, suspend, or discontinue all or part of the App as needed to add or improve features, perform maintenance, address security issues, comply with laws or platform rules, or for other necessary reasons.
2. Except in emergencies, we will give notice of significant changes or discontinuation by reasonable means, either before or after the change.
3. If paid features are materially affected, we will respond in accordance with App Store subscription procedures and applicable law.

13. Disclaimers and limits of liability

1. We do not guarantee that the App is free of factual or legal defects, suitable for a particular purpose, continuously available, or works correctly on every iPhone or controller. We do not guarantee any particular vibration strength, relaxation benefit, or other effect.
2. If our intentional misconduct or negligence causes you loss, our liability is limited to ordinary, direct losses.
3. These limits do not apply to intentional misconduct or gross negligence, death or bodily injury, or any other loss for which liability cannot be limited by law.
4. For losses caused by our slight negligence, our liability is capped at the greater of the amount you paid for the App in the preceding 12 months or JPY 1,000.

14. Governing law and jurisdiction

1. These Terms are governed by Japanese law.
2. Unless the law provides otherwise, disputes concerning the App will be subject to the agreed jurisdiction, at first instance, of the district court serving our address.
